What is whistleblowing?<\/span><\/a><\/h4><\/div><div id=\"341cccde1e44b9fa8\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_341cccde1e44b9fa8\"><div class=\"panel-body toggle-content fusion-clearfix\">The whistleblowing system is a channel within the company for reporting administrative, accounting, civil law and criminal offences or violations of the company\u2019s organizational models that have been committed in the context of one\u2019s work.<\/p>\n<p>Any person who, in the course of their activities and in the context of their work, learns that, as a result of their office or duties, an offence or violation has been committed that could harm the national public interest or the interests of the private company for which they work, has a duty and opportunity to report the offence or violation to an internal whistleblowing office. Who can be a whistleblower? <\/span><\/a><\/h4><\/div><div id=\"03d8d04721da62213\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_03d8d04721da62213\"><div class=\"panel-body toggle-content fusion-clearfix\">The whistleblowing channel is available to, and may be used by, any subordinate worker, including interns and volunteers, any non-employee worker, including freelancers, professionals and consultants, partners and shareholders and anyone working for the company in an administration, management, control, supervisory or representation role, to report offences or violations.<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-7716ef4a01ac20fa9 fusion-toggle-no-divider fusion-toggle-boxed-mode\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_7716ef4a01ac20fa9\"><a aria-expanded=\"false\" aria-controls=\"7716ef4a01ac20fa9\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-40305-1\" data-target=\"#7716ef4a01ac20fa9\" href=\"#7716ef4a01ac20fa9\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-chevron-double-up far\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-chevron-double-down far\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">3. Whom can I send the report to?<\/span><\/a><\/h4><\/div><div id=\"7716ef4a01ac20fa9\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_7716ef4a01ac20fa9\"><div class=\"panel-body toggle-content fusion-clearfix\">You can make a written or verbal report using the specific internal channel set up by the company, by sending an email to <a href=\"mailto:segnalazioni@menz-gasser.it\">segnalazioni@menz-gasser.it<\/a>, and attaching the <a href=\"https:\/\/www.menz-gasser.it\/wp-content\/publicpdf\/Modello-SW1c.pdf\" target=\"_blank\" rel=\"noopener\">whistleblowing form<\/a> prepared by the company to your email, or by requesting a confidential meeting directly with the internal whistleblowing office, which will be scheduled within 5 business days. <\/p>\n<p>You can report the offence or violation externally to ANAC (Italy\u2019s national anti-corruption authority), either in writing on ANAC\u2019s online platform or verbally using its telephone or voice messaging systems or during a direct meeting, but only if: a) the company has not set up an internal whistleblowing channel; b) you have already sent an internal whistleblowing report and it was not acted on; c) you have substantiated reasons to fear that, if you were to make an internal report, it would not be acted on or it would put you at risk of retaliation; or d) you believe that the violation could pose an imminent or clear danger to the public interest.<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-8aa6d8dea6ed43d07 fusion-toggle-no-divider fusion-toggle-boxed-mode\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_8aa6d8dea6ed43d07\"><a aria-expanded=\"false\" aria-controls=\"8aa6d8dea6ed43d07\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-40305-1\" data-target=\"#8aa6d8dea6ed43d07\" href=\"#8aa6d8dea6ed43d07\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-chevron-double-up far\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-chevron-double-down far\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">4. What can I \/ must I report? <\/span><\/a><\/h4><\/div><div id=\"8aa6d8dea6ed43d07\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_8aa6d8dea6ed43d07\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>The internal whistleblowing channel is expressly intended for reporting administrative, accounting, civil law and criminal offences or violations of the company\u2019s organizational model or code of ethics, which put the community\u2019s interests or the company\u2019s interests, assets or operations at risk of damage or harm.<\/p>\n<p>The channel is therefore meant for reporting crimes, offences or violations committed in the context of one\u2019s work. It is meant to protect the company and the victims of the crime, offence or violation. It is not meant for personal complaints. Any personal reports will be forwarded to the relevant offices to be handled.<\/p>\n<p>Examples:<\/p>\n<ul>\n<li>An employee reports mobbing by the head of a department. This is a personal matter, so the whistleblowing procedure does not apply. Therefore, the name of the accused party may be disclosed in the subsequent disciplinary proceedings even without the whistleblower\u2019s consent. Since the report in any case refers to a serious ethics and organizational violation, the office will take the appropriate steps to protect the whistleblower and it will forward the report to the HR office.<\/li>\n<li>An employee complains about not being promoted. This is a personal matter which does not relate to offences, but rather to assessments that employers may make at their own discretion. The whistleblowing procedure does not apply.<\/li>\n<li>An employee reports that the head of their department has ordered them to make a purchase that does not relate to production and which the employee believes is instead for the purposes of bribery (e.g., for a supplier\u2019s holiday). This concerns the company\u2019s interests, so the whistleblowing procedure applies. The whistleblower\u2019s name is protected and kept secret, except in the cases provided for by law.<\/li>\n<li>An employee reports that the head of their department has ordered them to dispose of potentially pollutant chemical products in a field behind the plant. This concerns both the company and the community. The whistleblowing procedure applies. The whistleblower\u2019s name is protected. Who handles whistleblowing reports?<\/span><\/a><\/h4><\/div><div id=\"e2249582608f94d29\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_e2249582608f94d29\"><div class=\"panel-body toggle-content fusion-clearfix\">The company has tasked an autonomous, internal whistleblowing office with managing the whistleblowing channel. The office is staffed with specially trained personnel supervised by an outside professional. <\/p>\n<p>The office receives the whistleblowing reports, manages and sorts them and acts on them, carrying out all the most suitable internal investigation activities in order to verify and respond to the reports, guarantee the whistleblower\u2019s confidentiality, protect the whistleblower from any possible retaliation, and have the company or the competent authorities take any other steps that are useful and necessary for resolving the report or dealing with the offence.<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-dc2b9c73b7c476452 fusion-toggle-no-divider fusion-toggle-boxed-mode\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_dc2b9c73b7c476452\"><a aria-expanded=\"false\" aria-controls=\"dc2b9c73b7c476452\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-40305-1\" data-target=\"#dc2b9c73b7c476452\" href=\"#dc2b9c73b7c476452\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-chevron-double-up far\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-chevron-double-down far\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">6. How will my report be handled?<\/span><\/a><\/h4><\/div><div id=\"dc2b9c73b7c476452\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_dc2b9c73b7c476452\"><div class=\"panel-body toggle-content fusion-clearfix\">Within seven days of receiving the report, the internal whistleblowing office sends the whistleblower a \u201cnotice of receipt of the report\u201d. The office handles the report within three months, informing the whistleblower of how the report will be acted on. <\/p>\n<p>While the report is being handled, the internal whistleblowing office may begin or continue discussions with the whistleblower and may ask for clarifications or additional information on the report.<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-59da7401f7001b5fc fusion-toggle-no-divider fusion-toggle-boxed-mode\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_59da7401f7001b5fc\"><a aria-expanded=\"false\" aria-controls=\"59da7401f7001b5fc\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-40305-1\" data-target=\"#59da7401f7001b5fc\" href=\"#59da7401f7001b5fc\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-chevron-double-up far\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-chevron-double-down far\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">7. How is the whistleblower\u2019s confidentiality protected?<\/span><\/a><\/h4><\/div><div id=\"59da7401f7001b5fc\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_59da7401f7001b5fc\"><div class=\"panel-body toggle-content fusion-clearfix\">The whistleblower\u2019s confidentiality is protected for the entire duration of the procedure and throughout all criminal and civil law or disciplinary proceedings resulting from the report. This consists of maintaining the secrecy of the whistleblower\u2019s identity, which is known only to the internal whistleblowing office and which may only be disclosed to those authorized to receive and act on reports, except when it is necessary to disclose the whistleblower\u2019s personal information or with the whistleblower\u2019s express consent. <\/p>\n<p>In internal disciplinary proceedings resulting from the report, the whistleblower\u2019s identity may not be disclosed if the charge is based on assessments that are separate and distinct from the report itself. However, if it necessary to know the whistleblower\u2019s identity in order to defend the accused party, the whistleblower\u2019s identity may be disclosed solely with their consent. <\/p>\n<p>If it is necessary to disclose the whistleblower\u2019s identity, written notice is given, stating the reasons.<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-5d350e90f3c033781 fusion-toggle-no-divider fusion-toggle-boxed-mode\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_5d350e90f3c033781\"><a aria-expanded=\"false\" aria-controls=\"5d350e90f3c033781\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-40305-1\" data-target=\"#5d350e90f3c033781\" href=\"#5d350e90f3c033781\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-chevron-double-up far\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-chevron-double-down far\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">8. What happens if someone makes a false or slanderous report about me?<\/span><\/a><\/h4><\/div><div id=\"80411319e3882524c\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_80411319e3882524c\"><div class=\"panel-body toggle-content fusion-clearfix\">The whistleblower\u2019s identity cannot be protected in the event of a false report or false accusations against someone known not to be guilty or that are proved false following an internal investigation.
